01About these terms

These terms are between you and Build Webby ("Build Webby," "we," or "us"), the company behind buildwebby.com. By using our website or buying from us, you agree to these terms. If you do not agree, please do not use our services.

02What we do

We build and set up websites for businesses. We offer three options:

• Pre-Built. One of our templates, set up with your logo, colors, contact info, and the content you already have.
• Pre-Built + Custom. Everything in Pre-Built, plus changes to make it fit your business, using your own words, photos, and ideas.
• Custom. A full website built from scratch, or changes to your current website. Custom work is quoted for each project.

All of our websites are made in the United States.

03Your free example website

We may build an example website for you at no charge so you can see it before you buy. You do not have to buy anything. The example stays ours until you pay. Please do not copy it, publish it, or use it without buying it.

04Prices and payment

Our prices are listed on buildwebby.com or in your written quote. Pre-Built and Pre-Built + Custom are priced as shown on our site, and Pre-Built + Custom may cost more depending on your changes. Custom work is priced in a quote.

You pay before we make your website live. If you choose our hosting, it costs $150 per month and is billed monthly. You may cancel hosting at any time. Cancelling takes effect at the end of the month you have already paid for, and we will send you your website files so you can host it yourself.

05No refunds

All sales are final. We do not give refunds. You see your example website before you pay, so you know what you are getting. This applies to Pre-Built, Pre-Built + Custom, Custom, and hosting fees once they are paid. If something is not right, tell us. We will work with you to fix it through your revisions.

Please contact us before disputing a charge with your bank or card company. We would rather solve the problem with you directly.

06Revisions

A revision round is one set of changes you send us together. Here is what each option includes:

• Pre-Built: one round of minor fixes and touch-ups to finalize your brand.
• Pre-Built + Custom: two full rounds of revisions. You can ask for whatever you need in them.
• Custom: up to three rounds of revisions over one month.

Work beyond what your option includes is quoted as Custom work.

07Timelines

The times we share are estimates. Pre-Built is usually live in 24 to 48 hours, Pre-Built + Custom in less than a week, and Custom in about a week. Timelines can change if we are waiting on your content, your domain access, or your feedback.

08Your content and your promises to us

You keep ownership of the logos, text, photos, and other content you give us. You promise that you own it or have the right to use it, and that it does not break any law or anyone else's rights. You also agree to give us the access we need, such as your domain name settings, to put your website live.

09Who owns the website

After you have paid in full, you own your website and your content. We keep the rights to our templates, page layouts, code, and tools. You get the right to use them as part of your website. We may show your finished website in our portfolio unless you ask us not to.

10Hosting

You can host your website with us or on your own account. If we host it, we keep it online and running as long as your hosting is paid. If a payment fails, we will tell you first. If hosting stops, we will send you your website files. If you want to host it yourself, we push the website to you and you sign up with a hosting company.

11Calls and texts

When you send us your phone number, you agree that we may call or text you about your project. Message and data rates may apply. You can reply STOP to any text to stop getting texts.

12What you may not do

Please do not use our services for anything illegal, harmful, misleading, or that breaks someone else's rights. We may refuse or stop work on any website for these reasons.

13Other companies

Some parts of your website may rely on other companies, like domain registrars, hosting companies, and payment processors. We are not responsible for their services, prices, or outages.

14No promises about results

We work hard to build fast, good-looking websites. But we cannot promise any exact result, such as Google rankings, traffic, or sales. Stories and quotes on our site describe the experiences of specific customers. Your results may be different.

15Limits on our responsibility

Our services are provided "as is." To the fullest extent the law allows, we are not responsible for lost profits, lost data, or indirect damages. Our total responsibility to you for any claim is limited to the amount you paid us for the service that caused the claim.

16Changes to these terms

We may update these terms from time to time. When we do, we will change the date at the top. If you keep using our services after that, you accept the updated terms.

17Which laws apply

These terms are governed by the laws of the state where Build Webby is based, without regard to conflict of law rules. Any dispute will be handled in the courts of that state.
